Probate is the legal process of administering the estate of a deceased person.  If you have not avoided probate with good estate planning and the use of trusts and other vehicles, you must go through probate court when a loved one dies.  Probate is necessary to settle the claims against the estate, to have a representative of the estate appointed and to adjudicate among the competing parties, often other family members, who may have a claim to the estate.
